At the time, they probably were "technically" false. As in, it was in a fail state but the decision hadn't been made yet, so anyone saying it was a fact wouldn't be honest for another season.
If devs really didn't hear shit until today and had games coming out, but the decision was literally made three months ago, it seems like there might be some contractual issues some of them could sue over.
