      It ran for a while. The US version was on the Aeria Games servers for a few years, had a bit of a fall off of user numbers so they switched from a multi-channel server to a sing channel, and then ended up being transferred to Atlus' own service for a few years before the end of service. The Japanese server ran pretty long and got all sorts of events, there was another fan server that has now also shut down in response to this that had them all added and was working on translating them all slowly.

            Some places have automatic payment for all lawyers coming from the loser of the case and most others can choose to do that.

            American rule, you pay for your own sides court fees generally.

    The private server was selling in-game items for real money through """donations""". Making money off someone else's IP is illegal. Blizzard already sued WoWscape server that did this and won in court. The precedent is already set that you don't operate private servers for money. It's why Sega isn't going after the Phantasy Star Online private server, all the money is funded from their pocket and they don't beg for donations.

      What's the cutoff for when donations turn into "profiting from the IP"? Like if someone makes a fan server, and their dev name is public, and when you search for that name you can reach a donation page, does that still count as profiting from the IP?

        I would imagine literally any amount at all, you would think maybe you'd have to prove some kind of increase after the IP project went live but I bet they wouldn't need to even do that much.

      Then the admins are pretty dumb. If you need help with server costs just ask for normal donations in a less public way, like on a discord server or something. I can't imagine a server for something like this could cost much anyways, just have a monthly goal of 20 bucks or whatever it is. Selling in game items gets you much more than you need to operate the server.

    Dude, Atlus is not your friend. It's a commercial enterprise. If you want to use their copyright, you need to ask them if they allow it. If they don't, then don't use it.

    This doesn't necessarily mean Atlus will sue you (just look at youtube and how many people violate Atlus' copyright). It simply means that Atlus can decide if they want to sue you or not.

    For example Let's Plays are a copyright violation, but most gaming companies do nothing because they don't really want to sue someone who plays their game. Especially on Youtube most companies at worse just give you a copyright strike without any legal follow up (except if you try to fight the claim).

    But the SMT server did more than just showing videos on Youtube. They sold stuff for a product they don't own. Atlus can always sue in such situations.
    Also if you ask yourself why the defendant is called "John Doe 1", it's literally a legal term used if you don't know who exactly is the owner.
