Hold the frick up. If you make something that someone else can seamlessly copy and sell and they do so without your permission, isn't that counterfeiting effectively? The only difference here between a physical bootleg and this is that they have the technological means to disable it remotely.

If full refunds are issued, there shouldn't be a problem.

Full refunds were issued, correct? You wouldn't leave out crucial information would you?

        >If you make something that someone else can seamlessly copy and sell and they do so without your permission, isn't that counterfeiting effectively?
That'd be copyright infringement, not counterfeiting. More importantly, what Nvidia is doing isn't either. They aren't selling a copy of the game data to people without permission (that'd be a question of first sale doctrine), they're letting you run a game, which you already legally paid for, on their server and then streaming the audio & video to your local client. Same thing as using Steam Link, except you're using Nvidia's hardware instead of your own.
Most importantly, I'm not just making stuff up here: users hosting and playing back content on another company's server was already decided to not be copyright infringement 15 years ago in Cartoon Network v. CSC Holdings. Nvidia is simply not pushing back because they're trying to play nice and not anger game companies by taking this to court.

              Anonymous

              They don't
NVIDIA is just an easy target, since the game had a big title card, description etc.
Functionally what they're doing is no different than if you streamed your desktop and chose what game you wanted to play. A fancy frontend doesnt change that. NVIDIA is providing a service that allows a user to stream what they already own
I believe that when one buys a game, they buy the right to play that game in whatever way they want, no matter what publishers or developers want. Allowing a developers to not let their customers play their games through a streaming service is like allowing developers to not let their customers play their games through certain monitors.

Incorrect. GeForceNOW is basically the Nvidia gamepass, you pay Nvidia a fee of 9.99 or some shit and get to cloud game a list of titles.

                Anonymous

You are the incorrect one here. With Geforce Now you pay Nvidia a monthly fee to stream games that you already separately paid for on a storefront like Steam or Epic, it's NOT the same as Gamepass where you get access a whole library of games from different companies by only paying MS once per month.

                Anonymous

yeah but from what I got from this thread, they are probably using the "available" games in "their" library to get people to pay them money, which is basically using their name and influence without giving them a cut or asking them first.

  11. 2 years ago
    Anonymous

In this case, it's a case of distribution so: Absolutely. If the devs of TLD didn't want it on Nvidia's storefront/streaming, they have the right to request it removed.

Technically is the same as claiming you own a piece of stolen art cause you paid for it legit.

If a 3rd party sells a product they were not licensed for, its not different that you buying an stolen piece of art, which make the whole transaction illegal.

If you subscribe to Geforce Now, you can install your already purchased games on Nvida's servers and then stream the games to your computer (this works with nearly any computer, so you don't have to build a gaming PC). The people who made The Long Dark didn't like this arrangement, and asked Nvidia to remove their game from Geforce Now.

Wait, what? You're installing your own copy and streaming it. It's not like you're buying it from nvidia or pirating it. wth? Is he moronic? Frick, maybe I'm moronic.

I can see why they were pissed. Imagine a company makes a switch cloud of a PS5 game and let's you play it if you own a ps5 copy, I ca see Capcom getting pissed. If I was a dev, I would tell them to remove it too.

Nvidia made of a bunch of games work with the cloud via their own virtual machines and let you play them on the cloud if you owned the game on steam essentially making cloud ports of games they didn't own. This obviously didn't go well with a lot of developers.
