Yes but it's not purely softmod either. You need to trigger recovery mode by grounding a physical pin, and from there you can inject code to boot CFW.
In theory you only need to do this once since Hekate allows you to set auto-RCM, but if for some reason you don't want this then it's every single time you boot the console.
I also played Mario Wonder and applied the update afterwards. Maybe it would affect something on a new playthrough but I doubt it.
Either CFW helps skipping version requirements or those games don't actually need it.

No you didnt because if you had, youd have to upgrade your firmware to 17.0+

If you're buying one of these it's for the existing library, so there'll never be a need to update firmware (which will probably kill this thing anyway).
Buy it if you want, dont come crying later when you brick your hardware. If you want pirated content just hard mod it

How do used games work then? As far as nintendo knows the pirated copy could be a legit copy the original owner sold and someone else who bought it is using in his switch
What Nintendo checks for is if multiple instances of a game with the same serial number are connected to their servers simultaneously, and it automatically bans your console if it detects that.

Hopefully it gets better, but for now if you want a hacked Switch you either find the old model or look for hardmods for newer ones.

It's impossible to put a custom menu software on it without modding your switch (which defeats the point of having a flashcart in the first place).
The console will only run nintendo-signed code. No custom software. No menus etc.
That's just how it is for now. You could get multiple small SD cards and put 3-4 games it or wait for V2 where presumably they will add a button so you could scroll through the games while it's inserted in.

Yeah, it's definitely more convenient. CFW is better but there's definitely a market for people who's lazy to frick around with their Switch just like Sky3DS. Like I said there's apparently going to be a V2 with a button so you don't have to remove it while you scroll through your SD card. If you don't like how it operates, nobody is forcing you to use it.
REMINDER: The R4 fricked up the connectors in your DS's card slot and included a time bomb so you would have to buy replacements. Don't fall for the meme and just wait for a proper solution.
