      That's not how the law works, in any capacity. And that legal disclaimer on their website is not credible and would not hold up in court, under most circumstance.
      Creating Fan Content does not allow the rights holder to automatic use of your creation. Why do you think music studios don't take down publicly posted music covers and re-upload or sell them for the potential profit? Or Comic Publishers re-releasing fan comics that proved popular?
      However, just because you create fan art doesn't give you any commercial rights ownership or allow for it's use (unless it's transformative enough or a parody) and GameFreak has every right to remove it from public consumption.
      We've even seen other game companies get into hot water for using fan content, like SEGA having to patch-out stolen fan-art from their games, it's just usually settled out of court or doesn't lead anywhere because of the fear of legal retribution for the fan releasing a potentially infringing piece of art first, even if that would typically just be a warning and a removal of said content.

          Their direct was released to an international audience through a subsidiary-company with a withstanding in the US and other regions, which have to abide by the rules, laws, and regulations of those regions if they are to commence commerce and business. As well, if the remix was made in a US territory and stolen by an international company for commercial use, that leads to a different rabbit-hole of industry rights and regulations between territories and international-trade agreements. It's not as cut-and-dry as 'GameFreak owns Pokemon, so anything anyone does with it is automatically their property!' because even in Japan, that's not how it works.

    If their medley was used for the trailer more than likely when TPC catches wind they'll have the trailer redone and reuploaded then request the previous version removed. If not there's likely a remixed version of the song in the DLC that just happens to sound alike. It wouldn't be the first time a fan creation gets extremely close to what a dev designs.       SEGA of America has been reusing assets from an Archie-hired contracted 3DCG artist they blacklisted and want nothing to do with due to internal drama.
      All of it was commissioned by SoA, they have full right to reuse it whatever they please, but they seem to not give a damn if it from someone they do want to ever work with again.
      So much they'll even leave you uncredited after the work you did with them, even if it's just remaking the same fricking model they had since the early 2010s. (This is a very common industry practice for cheap ass companies)
