However, in case of anonymously distributed works the original creator might not be able to sue because there's no way to prove he's the original creator.
I highly doubt this "sequel" uses the original code. The most it probably uses is the title of it.

Even the title and concept fall under copyright. Fricking YOMI Hustle had to change their name to an acronym because they got harassed by the gays that made Fantasy Strike, since that whole game is based off a card game of theirs called YOMI.
