He's the lead tech artist for ASW he can do whatever he wants and even if ASW objected the game he's making isn't even in the fighting game category so would probably skirt legal trouble. Most of your non-compete contracts are about using company assets for personal gain, neglecting work on the clock to work on something else, working or helping to make something that would compete with the companies bottom line. A regular ass action game has no influence on the fighting game genre and you can watch ASW GDC presentation to see that the methods used to make this artstyle are completely generic only requiring artistic ability and any 3D suite experience.
