Being derivative and copying elements isn't grounds for a lawsuit if the end product is legally distinct.

Nintendo fans have a very interesting view on the law given how they cry about emulation being illegal despite being proven that it's legal in the United States Court of Appeals for the Ninth Circuit.

The Better question is, "Is Nintendo making their own Palworld?"
Palworld's 20mil sales is pretty much all the proof in the world that there is a massive market for openworld survival crafting games with collecting mons. Slap a Nintendo seal of approval on "Pokemon Pals" and you have a multi-billion dollar product.

I need mass ore gathering tips. Passive bases and having to carry the weight of the world after each node is extremely boring.

Pump action shotgun replaces pickaxe. You can destroy boulders in a few shots, takes maybe a minute to clear out an area. Just go in with an empty inventory.

I'm just using Mammorest to level the entire node spawns, when I reach the shotgun level I'll try it, seems fun

Just keep in mind it’s more expensive to repair the pump action than a shitty pickaxe, but the sheer speed improvement for harvesting mining spots is worth it. Might be worth grabbing a few cattivas and lunaris for the extra carry weight just for mining expeditions, too. Passive bases fall off in the endgame when you start needing a shitton more materials, imo shotgun mining is the best way to do it. Don’t fall for the digtoise meme either, he’s broken.

Make your ore mining base your ORE MINING base. Get rid of plantations, stone and wood mills, or anything else that could distract your Pals from their jobs besides the ore, your smelters, and your production lines. Use Pals like Killamari, which are only capable of transporting, so they won't try to do anything else. It'll be a bit of a pain to run food and basic materials from a different base at first, but you it'll be worth it.

          Anonymous

Unfortunately the base despawns when I get far away and it stops working. I need to stay in that base to work, and if I need to stay in it I'm setting the laziest autofarming possible.

The fact that Nintendo hasn't gone after copycats in the past can be used against them in court, as it would be evidence that their motivation is tortious interference i.e. a malicious attempt to block a business from operating rather than defending their copyright. If Nintendo didn't go after clones like Keitai Denju Telefang, they're not gonna go after Palworld.

Because Japanese IP law is different to western IP law. They don't have fair use for example which is why they are so autistic about taking down game streams that don't have permission. But if an IP is changed even slightly then it is ok to use, like changing a single letter in a trademarked name. Even if you use the same colouring and font. Short of the original game assets themselves having been stolen there is nothing Nintendo could do. Nor would they want to open that can of worms around 'looks like' or 'clearly inspired by' because that then opens them up to litigation as well.

      Anonymous

      >But if an IP is changed even slightly then it is ok to use, like changing a single letter in a trademarked name
This is the same in western law too. Its dependant on the argument on whether a lay person can disambiguate between the two

      Anonymous

Japanese law only differs from western IP law in that Japan has a duty to protect authored works clause that offers more protections to authors of trademarked or copyright IPs. This would be advantageous to Nintendo if they felt the need to sue but they haven't pursued a lawsuit at this stage.

It wasn't close. King Kong was public domain and Universal got btfo'd. If it wasn't public domain then Universal themselves would've still been btfo'd because they would've been infringing on the original King Kong novel.

    You can't copyright game mechanics.
You can't copyright a visual style. (imagine if the producer of one anime with a generic japanese school student self insert character could sue another lmao)
The game is not in competition with Pokemon for it is in a different genre on a different platform on different hardware, so it is not hurting Nintendo's sales to any legally significant degree.
'Pal' is not trademarked by Nintendo, and Pal did not use any Trademarked names.

Some Pals did look a little close, those got changed before release. If you see a 3d wireframe compared to a Luxray, that's old Boltmane who got a visual overhaul. Same with Astegon.

Nintendo had 3 years to look into this, and have struck down other projects at far earlier stages with less success, so only acting now that Palworld made millions gives Pocketpair an equitable defence.

And if Nintendo did sue them now, it'd be damaging to their brand image, they'd be the big bully company shaking down the little indie heroes that could.

I lost all my respect for the game market, 2million players for literally stealing multiple years of community building by nintendo/gamefreak, literally living off of someone elses work, and people love it, people love it because its pokemon on pc, and the law has nothing to say against palword. People just love that it hurts a big company, they support whats toxic just to prove a point. People catch on to the hype train just because streamers say the word, and everyone knows streamers are the elites of this world so their opinion is sacred "a good pokemon game for pc". Everyone who supports this game just told every other company that trying hard is futile. Hard work and talent? Out the window...just copy someone elses work and steal their fanbase, thats the world we live in. Palworld literally sold better than pokemon legends arceus, which is such a beautiful game, made by talented and hard working people of gamefreak, but it doesnt matter. The market demands dull games, and toxic practices for someone to be successful, palworld proved to me that the world is a nasty place and i lost all my will to live, i literally want to off myself because i feel like i live in a cage of monkeys i stopped feeling like a gamer, i havent touched a video game since palworld's release im shaking every night and having suicidal thought and thinking if there's even a point to creativity, people love safe designs, to the point that i feel disconnected, one day they hate that games do microtransations to have money to pay their workers (which isnt alot aswell), and the second they give hunreds of millions to some quick unreal engine 5 game just because it hurts nintendo. Like the main goal of supporting the game is HURTING another company for not making an equal game. Were sadiatic, were easily exploitable, we have patterns, companies have tactics to target out attentions spans better we live in some kind of circus, and i dont know if ill lose my sanity or do something to myself first
