Again, no legal precedent. If Nintendo sued, you should be able to very easily look up the court records, but no records exist because the suit didn't happen. There is no legal basis/precedent for Cuphead to sue this game for copyright infringement, trademark infringement, or anything of the sort. You can look at Asylum films's legal history to see that this sort of thing has to be VERY specific. Their only lawsuits are because they used trademarks (For example, they were forced to change the name of their movie American Battleship to American warship because it was too similar to the movie Battleship it was copying) or because the release dates gave evidence that it was intentional trickery (For example, their Hobbit ripoff.) Otherwise, the movies are legally sound. In this case, there is no Cuphead release anywhere near this game's release and it uses nothing similar to a Cuphead trademark. It's simply legal and I'm not sure why you're confused about that.
