Mobile development relies heavily on emulation. The only real part of console emulation that holds any legal grounds is the piracy of IP through ROM downloads or using official BIOS files. If the emulator itself doesn't break any legal grounds, then there is no problem at all.

      It was about intimidating an emulator developer into shutting down. The core of their actual case was the claim that yuzu’s ability to bypass their game encryption was a DMCA violation, which runs afoul of prior jurisprudence on the DMCA (see Lexmark v Static Control Components).

      Nintendo had no case. They didn’t need to have a case. They just needed to scare a bunch of nerds with no budget for legal defense and no motive to risk the piercing of the corporate veil into abandoning the project.       What's funny about these arguments is that I'm watching this video on my phone in a 3" box. It still looks exactly like ToTK. I've played TotK on switch on a 200" projector screen at the native 1080p and it still looks great. "Fidelity" morons are really the most low IQ people around.     Is it really such a bad thing to emulate and/or pirate games you already bought? Like look, you can't really defend someone who just pirates the entirety of the Switch catalog because he wants it for free. That's a given. But some of us do genuinely buy our games, and want to enjoy them at higher resolutions, better framerates, and maybe with some quality of life additions. The corporate shills have yet to answer why this is such an abomination against mankind. If your argument is that "it's a lost sale" even if you already bought the game, then by that logic, even sticking to old hardware and playing just on the original rom is piracy, because you're not giving them money for new games. Using the family share option is piracy, since that's 1 sale when it could've been 2 or even 3. Lending games is piracy, since the company didn't authorize a transferal of ownership.

    What would appease everyone here?

          It's not a "sham" but yuzu was released by a LLC (Tropic Haze) so all they have to do is have Tropic Haze LLC default. The company "goes under", they lose all their "assets" (of which there are basically none), and they agree to "destroy all copies" of an open-source codebase that's already been mirrored a million times.

          The actual people making this emulator were, presumably, smart enough to just pay themselves salaries from Tropic Haze's earnings, or collect dividends. So their personal assets are safe and they have no liability. Tropic Haze LLC is the entity that settled and that is potentially liable for any wrongdoing. The individuals who made yuzu were just employees. Employees don't take the fall when a company does something illegal.

    emulators are not illegal as long as they do not use shit only found in the emulated console in the process of emulation. this is why dolphin is still a-ok. this is (most likely) why ryujinx isn't fricked. if emulators were outright illegal, they would be culled long, long before word of them reaches the common man - because nintendo is always on the lookout for emulators and ways they can sink the ship before it leaves the harbor. another big mistake yuzu did was advertising ToTK builds in their fricking patreon before the game was even out. i will not argue with dumb Black folk who do not understand the legality of emulators, but i will tell them that they are dumb Black folk, and why they are moronic apes. if you do not understand, you never will, and i will not dumb it down for you. that's what reddit is for.

    Its not though, yuzu settled to avoid the patreon pay (indirect funding) backlash. Its not illegal to emulate anything especially for archival purposes. Its not illegal to make copies of your own property as long as it does not affect copyright sales in the case of selling said copies. Breaking encryption on your own devices(property) is not illegal either (ex locks/keybreak on own home). The win is to convince the moronic, weak to fight(court), use it as an example for lawyers to point to and convince moronic judges and give clout to the butthole company.     Switch emulators are one thing, that's current gen, but what about games for older consoles that are no longer sold by Nintendo? I am unable to play, say, 3ds games without dropping hundreds of dollars at a vintage game/collector retailer or by downloading a ROM. With either method of acquiring a copy of the game, Nintendo "loses no money" and that's only if you make the generous assumption that people who pirate would otherwise purchase a console or copy of the game from Nintendo in the first place. I believe a wise fat man once said that piracy is primarily a service problem and he continues to be right to this day.
