Emu downloads usually have a similar warning just to cover their asses, but this is a discord server he's trying to protect, there are far worse things to find there if it gets looked into.

It's a plausible deniability thing. Emulators are not illegal, this has been established with court precedent. But the primary use case of emulators, to pirate commercial games, IS illegal. So every emulator project does this funny little dance where they feign virtue and claim they're only developing using self-dumped images and homebrew. It has everything to do with evading legal liability, like a lot of things in the US.
As for why that belongs in a pop-up alert, who knows. Probably an overly influential Discord mod whining at the UI guy about having to click the ban button too often.

Redump the game from your own Switch and then we can talk", probably more out of self preservation than anything else - Nintendo would LOVE to kill these emus and they could probably get some judge to rule its "mostly for piracy" if they can provide evidence that thousands of users in the Discord are posting logs that they're using unaltered scene file names with the pirate releease groups right in the tag etc, so they can't let anyone get one over on them .
