Nintendo is terrible when it comes to preservation of their old titles. DS is fricked especially because of the two screen shit. It's like they make their system intentionally gimmicky to make it harder to play the games on anything else but that system. So as a result you got desirable games in high demand but are not being produced anymore for a system not being produced anymore as well. Prices get jacked up due to supply and demand.
You can easily emulate DS games but you always got to deal with compromise of using one screen for a two screen system. So either having them both on the same screen or constantly flipping between the top and bottom screen with a button. Both are way less practical than playing it on native hardware.
Honestly even if Nintendo did release more virtual console DS games like they did on the Wii U, I doubt Game Freak would allow them to include DS Pokemon games since it would directly compete with their remakes
Companies could easily destroy this used game market grifter bullshit by making their games easier to play on modern consoles. Their laziness is taken advantage of by people looking to make easy money and making 2-3x the profit all going to their own pockets.

Putting custom firmware on a 3ds is piss easy and a ripped copy of one of these games is indistinguishable from a real copy, your moms will all be perfectly trade legal.
It’s not even like you can buy this stuff from Nintendo any longer, so paying a scalper for the physical copy won’t reward the labor of the creators. Literally zero ethical argument against piracy at this point.
