So they should just consolidate the Dam as their capital, muster their forces, and let the bandits in the east creep in to their former territory.
Build up once more, and then reclaim these weak bandit lands.
Instead, by backing off from the Dam AGAIN, you're just letting NCR/House grow exponentially stronger than the Legion ever will, giving them no shot at ever taking the dam.

for example if you found an NCR contingency plan for the Legion invasion and said contingency plan was not to fight him in open battle but rather go scorched earth
If you brought THAT up to him, that should convince him too, because it's objective final proof that he simply cannot defeat the NCR, not as the Legion is now
