As far as I know, on a long enough timeline Nintendo will come after this guy but I'm guessing it's a low priority, since it's not like they're losing money when they're not selling Emerald in any capacity whatsoever right now
eBay doesn't let you sell bootlegs. If you report the guy he'll be gone by tomorrow. "Reproductions" are a grayer area for ebay. They are still technically against the ToS but ebay generally don't care until the real copyright holder tells them to take it down.
the answer to "how do they get away with it" is, well, they don't. That's why most of the bootleg sellers have low feedback accounts because they are here today, gone tomorrow. If you see someone with more feedback than usual you'll find they got that selling OTHER stuff and the bootlegs are a new "venture" for them. The chinese use an army of western drop shippers and every time one gets banned another 3 take their place.
If by, "bootlegs," you mean a game using licensed characters that the developers didn't have the rights to, thay's arguably slightly more legal than literally just copying the ROM and burning it to a reproduction cart.
If by bootleg, you mean someone robbed someone else's copy of Pokemon Emerald and is selling it, that's usually not happening.

If you report these sellers they usually go away. Even if you want a bootleg, buying from ebay is moronic - go straight to the source and buy them from Aliexpress for $5 a piece instead.

weird that westerners call them bootlegs. i guess because it's unusual, it's likewise here we call unusual games "licensed" games which are official ones, and those are less common, so we wouldnt call common games bootlegs

Yes, and you support China by buying them. Import a cheaper Japanese copy instead. If you need an English translation of a JRPG, consider making the cartridge yourself as a learning process.
This is good advice. To add to it a bit:
1. Japanese isn’t hard to learn, it just takes time and patience. Get started now, and you’ll be playing games before you know it.
2. If you don’t want to better yourself, buy the Japanese ones for your shelf, and get a flashcart to actually play the English version. I mean, you’re buying games to play them, aren’t you?
I can’t even think of a single jrpg I’d play aside from maybe chrono trigger and Mario rpg if those even count

Answer is most likely no, not legally. You can timeshift people's game to different platforms, or create backups for them — that can be charged as a service.
