There is a complicated vetting process for these type of lawsuits where there is a claim of IP theft/infringement on a major commercial product. There isn't going to be a settlement. This will cost millions and take years to litigate. Pal world isn't going to recall its game or admit in any way they "stole" IP because that's a death sentence for their business. Nintendo will look like the biggest losers ever if they fight and lose this case.

There isn't going to be a settlement if this results in a lawsuit because the lawsuit is the death of the company. Nintendo will do a lot of research and there are lawfirms and private investigators that specialize in this. There might be a lawsuit, there may not be. It's going to be months before we know and trying to grasp at straws is pointless. The law firm might very well tell Nintendo they think there was some straight up copy/paste type shit going on but they aren't confident they can prove it.
