They better bring the sleaziest lawyers they can find then, because if they lose, you best believe that the flood work of obnoxiously obvious derivatives based on Nintendo franchises will run RAMPANT. Nintendo'll have to force themselves to choose whether it's even worth pursuing that many cases. It'll open the gates of slop like never seen before.

Aren't there already clones of Nintendo games in the market?

for-profit plagiarism and financial success. Possibly stolen assets.

I can see the plagarism angle for a few of the Pal designs, but isn't the worst-case scenario just... getting new designs? They'd be hard-pressed to argue the gameplay is a ripoff of Pokemon, given the divergence from Pokemon's format and the lack of similar claims made against prior knockoffs with even more adherence to Pokemon's format.

It's like that verboten horse cartoon fighting game from a few years ago, no? If they can't use designs that veer too close to existing IP, and presumably get slapped with some sort of legal consequence, just make new designs.

No it's not. This is why Rittenhouse went to jail. Regardless of whether his intentions were pure or not, he put himself in a dumbass situation where he was on the bad end of the law. And if they find there is in fact a mesh of the original pokemon underneath that is identical beyond a doubt to the switch models, Nintendo would crush them in a lawsuit provided there is no record of the creation of these meshes. I don't have to prove shit. Neither does Nintendo (if it is the case). Palworld devs would have to prove they are hand made copies used for reference.

It's just normal arbitration of a faceless company. Actually it's not normal, what they SUPPOSEDLY did, if in fact they did it, is really really stupid. Rittenhouse at least had a chance at a sympathetic jury which he eventually got.

This means nothing. It's an elaborately worded "no comment". Just because they use the word "case", that doesn't mean there is a case.

It's sort of like how when you fail a log in, websites will say that "your password and/or username was typed incorrectly". Because if they stated only the password was incorrect, then hackers could guess whether or not the username was right.

So when they say they're not commenting on cases, they're not specifying that they have a case. Only that they don't speak on cases. Meaning they may or may not have a case. You can't say one way or the other.

Despite what internet trolls think and shit post on X.
There is a complicated vetting process for these type of lawsuits where there is a claim of IP theft/infringement on a major commercial product. There isn't going to be a settlement. This will cost millions and take years to litigate. Pal world isn't going to recall its game or admit in any way they "stole" IP because that's a death sentence for their business. Nintendo will look like the biggest losers ever if they fight and lose this case.

There more going on than "yeah bro look at this concept art. Sure looks kinda the same. Maybe. Somewhat" that is going on in X threads.

Did someone else also make this point, because it's true.
There isn't going to be a settlement if this results in a lawsuit because the lawsuit is the death of the company. Nintendo will do a lot of research and there are lawfirms and private investigators that specialize in this. There might be a lawsuit, there may not be. It's going to be months before we know and trying to grasp at straws is pointless. The law firm might very well tell Nintendo they think there was some straight up copy/paste type shit going on but they aren't confident they can prove it.

Nah, if the Japanese judge agrees with Nintendo that Palworld devs are at risk of destroying evidence, they will get a police raid. Japanese police already raid companies if they suspect tax evasion.

You seem to be misunderstanding my point. I'm saying if there is a legal case, it won't be right away. There is going to be process to analyze everything before they file.

To sue for damages they'd have to prove that people could mistake Palworld for Pokemon and that cost them money, given that there's only some very vague similarities between a couple of characters and the games are otherwise completely different that'd be nigh impossible to prove.

Copyrights are less likely to be handed out in Japan although the enforcement is more strict. Those vtubers were probably given permission by Pockepair themselves to stream especially if they’re part of an agency

They can’t C&D Palworld for anything.

      Anonymous

Because they can't. If they're saying they're aware but they are not doing anything is it's because they're trying to find some kind of loophole to stop them. C&D is pretty fast these days and if they could they would've already sent them.

The best strategy for Nintendo is: recognize Palworld does not play on its turf, as it does not target the same audience, and its not in competition with the sales of its products and move on.
Alternative being, well, Iraq, and we all know how that turned out.
Will the trillion dollar military (pokemon company) risk pulling its weight against goat farmers(indie developers)? Maybe they're smarter than the US was and thought it's best to leave them the frick alone if they're not harming their turf. Nintendo/Pokemon won't do shit because they know better than you to pick the fights, and this is not it.

Palworld is the evidence on why video games can never be art.
You can write a book copying someone else, and you'll get destroyed.
You can make art copying someone else, and you'll get destroyed
You can make a movie copying someone else, and you'll get destroyed.
But video games? They'll cheer you for it, just like how the average gamer worship AI art, AI VA and AI gameplay letting them skip actually playing the game..
