You can always go to another store front like GOG or EGS and sell there with more strictly followed ESRB guidelines, but complaining that a private company that doesn't have to work with you isn't working with you because someone on staff doesn't like the content you make sadly wouldn't hold water in a court and law. Public trading would hold accountability to aim for profits, and a willing offer should be taken at it's value as a result, with investors accountable when unfair treatment is taken account of.

Steam banned the Dungeon Travelers game that released on Vita globally and the sequel that was finally translated into English (the ToHeart2 Dungeon Travelers version was approved though). They also gave an Adults Only rating to Gun Gun Pixies which is M on Switch globally. All content is the same.
