        Depends on the emulator, I set up Xemu recently and it turns out you have to trim bytes off every ROM file because the emulator only accepts a weird format instead of just accepting the disc dump.
        Took me an hour to figure this out.

    Why don't Nintendo do what? Sue Valve? It's an open-platform, you can install anything on it. It's not Valve's problem. Sue emulator creators? If they could, they would. Sony sued a dude who made a PS2 emulator, and the courts sided with the emulator's creator. Emulation is perfectly legal in the United States and Europe. Sue people uploading roms on the internet? It's basically piracy, but I'm sure whoever hosts roms is very careful, so they can't find whoever is responsible.

      Both are a lost sale and both need one person to buy the game. And lets say, for examples sake, this friend we borrow from is friends with as many people as they can, like how as many people pirate as they want.

      We don't have a full blown pirate epidemic or something, we've never seen sales of 1st party games in the hundreds. So...what is the issue?

        It's a legal question that comes from the principle of private ownership and private copies. You own the copy of the game you bought and you have the right to lend it to your family and friend. But the people which you lent the game to are not supposed to continue playing it once they gave it back. You also have the right to make private copies of what you own, but not disseminate them to others apart from your family and friends.
        On the other hand, piracy is not legal at all as you have no rights to make numerous copies of something, even if you have bought one.
        It is not well adapted to digital products.

      It's good for most stuff, but of course there's always problematic titles, specially if it's a recent release. I've beat most first party Nintendo games with 0 issues so far, other than my 8 year old CPU not giving me stable 60fps at times, but games that drop hard on a Switch usually runs way better and at 4K even, and I can run some 30fps titles at 60fps with patches so it's still fine.
      But I heard if you have AMD on Windows you'll definitely face issues since their drivers have some broken stuff that the emulators rely on.

              Nope, it's their own shit, which is why it sucks, ironically. Your regular PC emulators have been in development for over a decade and have a bigger focus on accuracy so they can run just about anything without major issues, while these are probably developed by some small team at NERD within a year and rely on tons per titles hacks to render stuff mostly right.
              Just look at the state of Zelda OoT on Switch when it was released, not even UltraHLE, an emulator released over 20 years ago had some of these rendering issues.

    Emulators themselves are shockingly not illegal, iirc. It's by some weird technicality. Something like it being a program made from scratch that is able to play the files of a console's games is actually fine. It's even legal to use games you paid for and dumped yourself to play on an emulator. The only issue is downloading the games via piracy.

      It's because emulators are technically competing products created through reverse engineering which Copyright deliberately doesn't protect against.

      It is legal to write a program to emulate another piece of hardware provided you reverse engineered it. If I just write code that can process instructions the same way a Z80 or 68k can, using public information about those chips, no law is broken and I didn’t violate anyone’s copyright or patent or trade secret.

      Thing is, a lot of the emulators out there now, the way they are used today IS illegal because they are using copyrighted/ripped BIOS.

      This is why Nintendo incorporated copy protection in their name and logo on systems like the GB and FDS, as soon as pirates incorporated that logo into their illegal software they were breaking copyright law.
