Sakurai already said other devs had to seek him out if they wanted their characters in Smash. Sakurai only shows favoratism towards Nintendo franchises out of obligation. That means Square-Enix had to contact Sakurai to have Sora in Smash
Afaik square doesnt actually own sora since disney owns kingdom hearts. Ive heard theres exceptions but i doubt with a deal that big disney wasnt the biggest hurdle considering they already had cloud and sephiroth

But because Smash is a crossover game and so is KH, Nomura was afraid of the implications for the Kingdom Hearts canon. Seems like he chilled out about that. When you remember SE was also the same company that kept FF from having any spirits in the base SSBU, it makes a bit more sense.
