It's really not that simple. Cooloff periods have limitations and exemptions to the rules. One example is audio/video or software of which the seal has been broken.

The mistake you made was doing a charge back first. From Nintendo's perspective, they're just seeing someone buy something and then have the bank cancel the charge to get their money back.
Always change your password immediately and then call the game service first, let them know it was an account breach and have them return the money and remove the content from the account.
Otherwise yes, a chargeback is against the TOS.
Does it suck? Yeah, it does, and it's shitty it's how it has to go, but it's part of the TOS we all agreed to.

Chargeback is a guaranteed way to get yourself banned from anything online. Also nintendo has a 0 refund policy. That being said one time my account got hacked and they bought 600$ worth of vbucks so i called nintendo and was polite and kind to the rep on the phone and they told me to give them my switch id and they would refund my money and ban the other switch that used it. So yea try calling nintendo and dont be a dickhead to the rep and maybe they will repay it with a unban request to whatever department handles that stuff

They usually look at the history. If you dispute buying milk on a tuesday at a store you buy milk at every tuesday its usually clear you dont get your money back.
Internet purchases (like buying a nintendo video game) is harder to get a history on as its usually less consistent, its almost always successful. Keep in mind there are serious consequences for abusing it.
The problem is that Nintendo does not offer refunds, not that OP did a chargeback on them.
