i don't think there was ever a plan to scam actual end customers on steam. what they likely planned on doing was making fancy demos to get investors on board and then using investor money to pay their own salaries as long as possible.
as for why the end product sucks, well, it's probably just plain old incompetence and the fact that they didn't really work on it. it's possible they also embezzled funds to some hidden accounts somewhere, and that's why the game sucks, but really there's real need to do illegal scamming when legal scamming does the job almost as well and has 0 risk
It was never about getting money from Steam sales. Steam pays out on a monthly or bi-weekly basis and the Day Before was only up for four days. It was a complete and utter investor scam and the brothers were paying themselves like a 250k salary over 5 years while claiming near a million in travel expenses.
But investor money needs to be paid back, it's not like kickstarter or patreon where if the project fails it's "tough luck, your money's gone"

Fall guy is either someone who'll do it without getting paid or they'll get money in other ways. In either scenario he ends up with no significant money directly from the company, and the company won't have anything left either since everything went to independent contractors.
So the only people who end up with money are seemingly third party contractors who had no idea there was a scam built around this whole company. good luck suing them, especially if they're in a foreign country.
