This would never work as a premise. If such a lawsuit were to succeed, then no dev would ever be allowed to update/patch/alter their game before or after release ever again. Imagine a company shipping a multiplayer arena shooter game. A month after launch, they rebalance some of the weapon spawn points. Now I can file a lawsuit because when I bought the game the rocket launcher spawn was over here and now its over there and there's now way you can prove that I didn't buy the game just for that one feature.

They would have delayed the game and made a public announcement about how they find it unacceptable. DMC5 was a result of capcom overcorrecting on Playstation due to fear during publishing, but they still released it on other platforms uncensored. Yeah you can make characters naked, but the game panders to gays more than it does to straight men.
For male characters, you can alter their dick size and have dick and ball jiggle physics, but for female characters, you can't make them curvy or customize their genitals. Also no jiggle physics.
Most of the female party members are not designed with beauty/sexiness in mind. The only one that looks decent is shadow heart and maybe karlach. But even then they are 6 -7 out of ten at best and are not curvy.
So the game is a very mixed bag overall.

Actually I did and the sexy character and outfits were the cherry on top. In all honesty the game isn't even really anything to write home about. The music, Lily and Eve being some very nice eye candy are the best things about the game for me.

This would never work as a premise. If such a lawsuit were to succeed, then no dev would ever be allowed to update/patch/alter their game before or after release ever again. Imagine a company shipping a multiplayer arena shooter game. A month after launch, they rebalance some of the weapon spawn points. Now I can file a lawsuit because when I bought the game the rocket launcher spawn was over here and now its over there and there's now way you can prove that I didn't buy the game just for that one feature.

One of them is this Nick Calandra guy who works on Second Wind, the youtube channel carried by yahtzee. He was going to make a video to expose all the grifts mark kern had done, but now his own sources turned on him and call him a liar lmao

None of this happened. He wanted to investigate Mark Kern's claim to fame as the creator of WoW, then found out about his Firefall fiasco and the scam that is Em-8er and went down a rabbihole. He discovered Kern's top reply-guy, a furry inflationfetishist, backed this game with $15, only to 1 year ago become diissilusionned with the project and call Mark a scammer and threaten to shoot up Mark and his team. 1 year later he suddenly changes his tune and is now his most loyal hound and refuses to explain why.
Then 1 month ago he discovers Nick is investigating the same game after Nick reached out to him about his grievances with the project and sudden flip flop on Kern, and decided to perform the most gayest of gay ops imaginable by creating a fake discord, an army of fake identities which he made appear to be real people, gave Nick fake DM screenshots of his fake discord conversations he had with his multiple fake personas, but it was not only he leaked part of the chat logs to complain about being banned from this (fake) discord that Nick assumed all of them were real. Because who the frick would think anyone would go to this length to gayop on behalf of a scam game, let alone a scam game that said person had as little as a year ago had meltdowns over being "scammed" by.
Then he goes "HAHAHAH I TROLL YOU LOLOLOLOLOL", only making himself look like a lying moron and destroying any credibility he had, and then Kern comes out and basically confirms he was also involved in this gay op to effectively collude against Nick (which is a literal felony btw) and just making everything surrounding Mark's game look even more suspect.
