Among all things, this also says they will not give any credit to a fanartist if they take their ideas. So, the similarities we saw between certain fakemons and new mons might not be random.

is this like when the EU was supposedly gonna ban memes?

      Anonymous

no because companies always could (and in fact are obliged to) go out of their way to scrub fanart off the internet to protect their brand

it just says israelitetube though. what about sites like pixiv?

Pixiv is a Japanese website, so you'd have to look at TPC and Japanese law instead.

it's standard for most IPs now. Also especially necessary because Nintendo has a subsection of communist wannabe fans who think their fangame or mods should be completely legal and they can do whatever they want with it. Meleegays and "Hey guys I got 20000 likes on my fangame. Come watch my twitch" are notorious for this.

pretty sure this isn't legal. pretty sure transformative works supercede someone on a website saying 'btw i own every thought you ever had about a character i own '
in fact, im pretty sure this isn't how copyright works at all and at best it's a trademark issue.

what if you never accepted those terms, aka didn't buy any of the shitty new games, and decide to make fanart

  13. 9 months ago

as long as the work is tranformative its protected speech nintendo's eula or tos isn't a binding agreement.

          Anonymous

art drawn in your particular style and designs is absolutely protected speech, in fact you could trace official pokemon designs and nintendo would have a hard time with it legally, especially when you consider what damage is supposed to have been done by THAT particular drawing exactly.
